This Prize Draw is in no way sponsored, endorsed, administered by, or associated with Meta Platforms Ireland Limited (“Instagram”).
Eligibility: This New York Jets and Pubity Sport Instagram Prize Draw (“Prize Draw”) is open only to individuals who are permanent legal residents of the United Kingdom, 18 years of age or older at the time/date of entry. Void outside the United Kingdom and where prohibited by law. Employees, officers, directors, agents and representatives of New York Jets LLC (hereafter, “Sponsor”), the National Football League, its member professional football clubs, NFL Ventures, L.P., and each of their respective parents, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, advertising & promotion agencies (hereafter collectively, “Released Parties”), and each such individual’s immediate family members (mother, father, sister, brother, child, husband, wife & their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. All applicable laws apply.
Promotion Period: Prize Draw starts 12:00:01 am British Summer Time (“BST”) on 29 August 2023 and ends at 11:59:59 pm BST on 26 September 2023 (hereafter, “Promotion Period”).
How to Participate: During the Promotion Period, entrant’s will be asked to like and comment on a Post on Instagram (hereafter collectively, “Submission”) by logging into their Instagram account, being sure their Instagram profile settings are set to public and follow both @newyorkjetsinuk and @pubitysport. During the Promotion Period, @pubitysport will publish a Prize Draw promotion via their Instagram account (“Post”). Consumers will be instructed to “like” and “comment” on the Post. Entry Comments may not be vulgar, inappropriate, use profanity, abusive, or otherwise deemed by Sponsor in its sole discretion to be in poor taste or violation of Instagram’s terms of use. All information submitted via the Instagram platform is subject to Instagram’s Privacy Policy accessible at https://www.instagram.com/about/legal/privacy and Instagram’s Terms of Service and Instagram’s Rules and Policies. All information submitted via Instagram and shared with any of the Released Parties per your Instagram account settings, or submitted directly to any of the Released Parties in connection with the Prize Notification process, is subject to, and will be treated in a manner consistent with, Sponsor’s Privacy Policy accessible at https://nyjetsinuk.com/privacy-policy. By commenting properly on the Post, you will automatically receive one (1) entry. The content of the Entry Comment will not be used as a factor in determining the winner and will not in any way affect your chance of winning, except to the extent it violates these Official Rules and results in disqualification. If you do not have an Instagram account you may sign-up for free by visiting Instagram.com and following the enrollment instructions. By posting an Entry Comment, you are acknowledging and agreeing that Sponsor has the right to use your Entry Comment as set forth in these Official Rules. Sponsor may not receive entries that fail to strictly follow the instructions set forth in these Official Rules and Sponsor is not responsible for failure to see or receive an entry. NOTE: Sponsor may not receive entries from Instagram users with “private” account settings (i.e., user has set their Instagram Account so that only people the user has approved can view their photos) due to the way Instagram operates its service. Messages not received by Sponsor will not be entered into the Prize Draw.
Entrants may participate in the Prize Draw via their mobile device and/or computer. Prize Draw is not skill-based – submissions will not be judged. Data rates may apply to entrants who submit or participate via a wireless mobile device.
All Submissions must be received by 11:59:59 pm BST on 26 September 2023 to be eligible for this Prize Draw. There is a limit of one (1) Submission per Instagram account for the duration of the Promotion Period. If any entrant submits more than one (1) Submission, then all Submissions received after the first Submission will be void. Any attempt to use multiple names or Instagram accounts or other tactics to enter more than the stated limit may result in the disqualification of the Submission by the Sponsor from the Prize Draw and all associated entries will be void. No Released Party is required to enter into any correspondence about Submissions, nor to acknowledge or return any Submission.
Incomplete Submissions, Submissions that do not comply with the Submission Guidelines (outlined below) or any images or language communicating messages inconsistent with the positive images to which Released Parties wish to associate will be void. See Submission Guidelines below for additional criteria. All Submissions must comply with applicable Instagram (https://help.instagram.com/581066165581870) rules and terms of service. Subject to these Official Rules and Instagram terms of service and except where otherwise prohibited by law, all Submissions become the physical property of Sponsor and will not be returned. Your participation constitutes your permission for Sponsor to obtain, use, and transfer your Submission, and to use your name and Instagram username, address and/or other details (collectively, “Prize Draw Data”) for Prize Draw administration purposes.
Released Parties are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, damaged, inaccurate or undelivered Submissions, direct messages, replies, Submission comments/photos, Tweets, re-tweets, emails or Prize Draw Data, theft, destruction or unauthorized access to, or alteration of Prize Draw Data, defect/delay in transmission or communication, including, but not limited to, Instagram hashtag use or for telephonic, human or computer failures, problems or errors, interruptions in service, whether via Instagram or otherwise, due to system upgrades, repairs, modifications or other causes, defect or delay in transmission, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions, errors or delays, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Prize Draw, including, without limitation, errors which may occur in connection with the administration of the Prize Draw, the processing of direct messages, emails or Submissions, Prize Draw Data, the announcement of prizes and winner, the cancellation or postponement of the Prize Draw, for any injury or damage to participant’s or any other person’s computer or other device relating to or resulting from participation in this Prize Draw, or for printing, typographical, human or other errors appearing in these Official Rules, in any Prize Draw-related advertisements or other materials. Sponsor may void Submissions of any entrant who Sponsor believes has attempted to tamper with or impair Prize Draw administration, security, fairness, or proper play. Use of any device to automate or subvert Submission is prohibited and any Submissions received by such means will be void. No software-generated, robotic, programmed, script, macro or other automated Submissions are permitted and any entries received by such means will be void.
Submission Guidelines: In addition to all requirements described above, all Submissions are also subject to the following requirements and prohibitions:
(1) Submissions that contain or otherwise infringe on any 3rd party names, trademarks, music, identities, copyrighted material, and/or other material subject to 3rd party rights are prohibited;
(2) Submissions that are obscene, offensive, contain any profanities, endorse any form of hate or hate group, or any language or images communicating messages inconsistent with the positive images to which Released Parties wishes to associate will be void;
(3) Submissions cannot be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, or contain nudity or any materially dangerous activity;
(4) Submissions cannot promote illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;
(5) Submissions cannot contain disparaging remarks, defame, misrepresent, invade the publicity, 3rd party rights and/or the privacy rights of Sponsor, Released Parties, their products or any trademarks or other intellectual property they own, other products or companies, or any person, living or deceased;
(6) Submissions cannot contain trademarks owned by others, or advertise or promote any brand or product of any kind, without permission, or contain any personal identifiable information, such as personal names, email addresses, etc.; and
(7) Submissions cannot be in violation of any law, statute, regulation, or ordinance.
Sponsor reserves the right to void any Submission and disqualify entrant not satisfying these requirements, in its sole discretion.
By submitting a Submission, you represent and agree that: (i) the Submission does not violate any law or regulation or any right of any third party, including those laws, regulations, and rights related to copyrights, trademarks, publicity, or privacy; (ii) you have the right to grant the rights to a Submission as provided in these Official Rules; (iii) the Submission has not been published or submitted in any other competition; (iv) the Submission is your original work; (v) you have obtained permission from any person whose name or likeness is used in the Submission; and (vi) publication of the Submission via various media including social posting, will not infringe on the rights of any third party. You will indemnify, defend and hold harmless Sponsor and the other Released Parties, and Instagram from any claims to the contrary. Further, by submitting a Submission, you grant permission and a non-exclusive, royalty-free, worldwide, irrevocable right and license for Sponsor and Sponsor’s affiliates to publish, post, adapt, edit, display, and/or modify or otherwise use the Submission in any form, in any manner, and in any media, without any time or territorial limitation, deemed appropriate by Sponsor or the Sponsor’s affiliates, without compensation of any kind to you, and you waive all moral rights in relation to it. You further agree that submission of a Submission is gratuitous and made without restriction and will not place Sponsor under any obligation and that Sponsor is free to discuss or otherwise disclose the contents contained in the Submission on a non-confidential basis to anyone or otherwise use the content without any additional compensation to you. Sponsor reserves the right to screen Submissions, but may post Submissions without editing or other prior review. You acknowledge that Sponsor has no obligation to use or post any Submission that you submit.
Winner Selection: Potential winner will be selected in a random drawing conducted on or about 27 September 2023 from among all eligible entries received during the Promotion Period. Drawing will be conducted by Sponsor. By participating, entrants agree to the terms of these Official Rules and to the decisions of the Sponsor, which will be final and binding in all matters relating to the Prize Draw. Potential winner will be contacted by Sponsor’s designated representative ‘Pubity Sport’ via direct message to the potential winner and such potential winner will be required to respond as instructed via direct message to Sponsor and provide their contact information within three (3) business days of issuance of notification. The winner will not receive communication from any other account. Be aware of accounts impersonating ‘Pubity Sport’. Sponsor shall have the right to announce the winner on its social feeds, in its sole discretion. Odds of winning will depend on the total number of eligible Entries received. Prize will be awarded to the person that is the authorized account holder of the Instagram account from which a winning Submission was submitted, subject to eligibility verification, and compliance with these Official Rules.
One (1) Grand Prize: Winner will receive one (1) Aaron Rodgers New York Jets jersey. Approximate Retail Value (“ARV”): £112.00 GBP. All prize details not specifically set forth herein will be determined by Sponsor in its sole discretion. The ARV of the prize is based on available information provided to Sponsor. Unclaimed prize will be forfeited. The Released Parties are not responsible for and will not replace the prize if lost, mutilated or any stolen prize that is undeliverable or does not reach a winner because of an incorrect or changed address.
Privacy: Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this Sweepstakes or on a Sweepstakes winner’s list. Except where prohibited by law, acceptance of a prize constitutes each winner’s irrevocable permission for Released Parties, each of their respective agents, successors and assigns or other designees to use winner’s name, likeness, photograph, voice, statement, opinions, username, Instagram profile, biographical information, prize and/or state/city of residence for advertising and promotional and publicity purposes in any and all media or format, worldwide, in perpetuity, without any permission, notification, payment or consideration, except for the awarding of the prize to the winner.
Miscellaneous: No transfer, assignment, cash redemption or substitution of a prize (or portion thereof) will be permitted, except by Sponsor, in its sole discretion, due to prize unavailability or other causes otherwise determined solely by Sponsor, and then for a prize (or applicable portion) of equal or greater value. If any prize or prize notification letter is returned as undeliverable or the prize is declined for any reason, potential winner will be disqualified and, at Sponsor’s sole discretion and time permitting, an alternate winner may be selected by random drawing from all entries received. Should a potential winner decide to decline his/her prize for any reason whatsoever or not respond to the prize notification by the applicable response deadline, Sponsor shall have no further obligation to that potential winner and an alternate winner may be randomly selected from among all remaining eligible Prize Draw entries, if time permits.
The Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s email account to receive email messages. The Released Parties are not responsible for any changes or unavailability of the social media platform used for purposes of administering this Prize Draw that may interfere with the Prize Draw (including any limitations, any restrictions, or any conditions on Sponsor’s ability to use the social media platform for the Prize Draw as set forth herein that are not acceptable to Sponsor) or ability of entrant to timely enter, receive notices or communicate with Sponsor via the social media platform, in which case Sponsor, in its sole discretion, may terminate or modify the Prize Draw. By participating, entrants agree to be bound by these Official Rules and agree that Released Parties and their designees and assigns and all of their respective officers, directors, employees, shareholders, representatives, agents, and the franchisees of any of them shall have no liability and entrant will defend, indemnify and hold harmless the Released Parties from and against any liability, loss, injury, or damage of any kind (including attorney’s fees) to any person or entity, including, without limitation, personal injury, death or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of: (i) entrant’s participation/entry into the Prize Draw; (ii) any materials he or she may submit in connection herewith; or (iii) the acceptance, possession, use or misuse of a prize or participation in any activities associated with the Prize Draw or any prize awarded in connection herewith; (iv) the Released Parties’ violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; and (v) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Prize Draw activity and/or prize. Notwithstanding anything elsewhere in these Official Rules, no person’s or entity’s liability for death or personal injury caused by its negligence shall be limited in any way, and nor shall their liability for fraud or for any other matter where liability may not as a matter of law be limited or excluded.
The Released Parties are not responsible for the actions of entrants in connection with the Prize Draw, including entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Prize Draw. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Prize Draw and to modify, suspend, and/or terminate this Prize Draw (or portion thereof) should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Prize Draw and, in the case of termination, at its discretion, select winner via a random drawing from all eligible, non-suspect entries received prior to the event that required such termination. In the event Sponsor is prevented from continuing with the Prize Draw by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Prize Draw by any party, or any federal, provincial or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure Event”), Sponsor shall have the right to modify, suspend or terminate the Prize Draw or prize. Sponsor additionally reserve the right, in their sole and absolute discretion: (a) to modify, suspend or terminate the Prize Draw should causes beyond Sponsor’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Prize Draw; or (b) to disqualify any entrant found to be, or suspected of: (i) tampering with the entry process or the operation of the Prize Draw; (ii) acting in violation of these Official Rules; or (iii) acting in an un-sportsmanlike manner. Wherever these Official Rules provide for discretion exercisable by a Released Party that could otherwise be capable of causing a significant imbalance in the parties’ rights and obligations under these Official Rules, to the detriment of a consumer and contrary to the requirement of good faith, that discretion shall be exercised reasonably and in good faith.
CAUTION: Any attempt to undermine the legitimate operation of this Prize Draw may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor and the applicable Released Parties reserve the right to seek damages (including attorneys’ fees) and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law. Released Parties make no warranty, guaranty or representation of any kind concerning any prize (or any portion thereof), and disclaim any implied warranty. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Prize Draw, shall be governed by, and construed in accordance with, the laws of England, without regard to any other conflicts of law principles. All entrants consent to the jurisdiction and venue of the county and municipal courts of England. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Prize Draw-related materials, and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
Winner’s Name: For the surname and county of the winner (available where applicable after 27 September 2023), send a self-addressed, stamped envelope to be received by 29 November 2023 to: SPORTFIVE, Attn: Jets Instagram Winner, 40 Water Lane, Wilmslow, Cheshire, SK9 5AP, United Kingdom. The winner’s surname and county where applicable will be available until 29 November 2023. If you object to any or all of your surname, county and winning entry being published or made available, please contact Ben Carter at ben.carter@sportfive.com. In such circumstances, Sponsor must still provide the information and winning entry to the Advertising Standards Authority on request.
